1. Acceptance of Terms

Welcome to ZenBookr. By using our website and mobile application (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the Platform. We reserve the right to modify these Terms at any time. Changes will take effect from the date of publication on the Platform.

2. Description of Service

ZenBookr is a platform that connects wellness professionals with clients. We offer:

• Professionals: tools to manage calendar, bookings, payments, clients, and services
• Clients: ability to discover, book, and pay for wellness services on-site or at home
• Marketplace: showcase for professionals to acquire new clients

ZenBookr acts as a technology intermediary. Contracts for services are directly between professionals and clients.

3. Registration and Account

3.1 Requirements

To use the Platform, you must:

• Be at least 16 years old (or 18 years old for professionals)
• Provide accurate, complete, and up-to-date information
• Maintain the security of your login credentials
• Notify us immediately of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur through your account. ZenBookr is not liable for losses arising from unauthorized use of your account.

4. Subscription Plans and Payments

4.1 Starter Plan

ZenBookr offers a single Starter plan that includes all features:

• Free trial: 30 days with all features active
• Launch promo: €3.99/month for the first 6 months
• Standard price: €5.99/month after the promotional period
• Zero commissions: keep 100% of your earnings

4.2 Billing

Subscriptions are billed monthly in advance. Payments are processed through Stripe.

4.3 Cancellation and Refunds

You can cancel your subscription at any time from the account settings. Cancellation will take effect at the end of the current billing period. We do not offer refunds for partially used subscription periods.

5. Professional Obligations

5.1 Legal Requirements

Professionals commit to:

• Possess all necessary licenses, authorizations, and insurance to operate
• Comply with all applicable laws and regulations
• Issue proper invoices to clients
• Properly manage the tax aspects of their business
• Provide professional and quality services

5.2 Content and Information

Professionals are responsible for the accuracy of the information provided (service descriptions, prices, hours, photos). Inappropriate, misleading, or illegal content may lead to account suspension.

6. Client Obligations

Clients commit to:

• Provide accurate information for bookings
• Show up on time for appointments or cancel with adequate notice
• Respect the cancellation policies of professionals
• Behave respectfully towards professionals
• Pay for booked services according to agreed terms

7. Payments and Commissions

7.1 Payment Processing

Online payments are processed through Stripe. ZenBookr does not store credit card data. The professional receives payment minus marketplace commissions (if applicable) and Stripe's payment processing fees.

7.2 Commissions

With the Starter plan, ZenBookr does not charge commissions on bookings. The only applicable fees are Stripe's for card payment processing (approximately 1.5% + €0.25 per transaction).

8. Cancellations and Refunds (Services)

Each professional can define their own cancellation policy. Clients must respect such policies. In case of disputes, ZenBookr may intervene as a mediator but is not obligated to do so. The final decision rests with the professional.

9. Reviews and Ratings

Clients can leave reviews and ratings. Reviews must be:

• Truthful and based on real experiences
• Respectful and not offensive
• Free of discriminatory or illegal content

We reserve the right to remove reviews that violate these criteria.

10. Intellectual Property

All Platform content (texts, graphics, logos, software) is the property of ZenBookr or its licensors and is protected by copyright, trademarks, and other intellectual property laws.

Content uploaded by users (photos, descriptions) remains the property of users, but you grant ZenBookr a worldwide, non-exclusive, royalty-free license to use them on the Platform.

11. Limitation of Liability

ZenBookr provides the Platform "as is" without warranties of any kind. We are not liable for:

• Quality, safety, or legality of services offered by professionals
• Accuracy of information provided by users
• Disputes between professionals and clients
• Indirect, incidental, or consequential damages
• Loss of profits or data
• Service interruptions

12. Indemnification

You agree to indemnify and hold harmless ZenBookr from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

13. Suspension and Termination

We may suspend or terminate your account in case of:

• Violation of these Terms
• Fraudulent or illegal behavior
• Non-payment (professionals)
• Platform abuse

14. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute, the exclusive jurisdiction shall be the Court of Italy.
